Summary/Abstract: The text analyzes the characteristic features of the act of domestic violence as a legal fact, examining whether it can be qualified as an unlawful act and whether it gives rise to the possibility of legal liability for the perpetrator. To this end, the study explores the issues of unlawfulness, social danger, harmful nature, guilt, and legal capacity in the commission of an act of domestic violence. The protection against domestic violence is analyzed in comparison with civil, criminal, and administrative-penal liability. The final conclusion is that the act of domestic violence constitutes an unlawful legal fact, which has its own specific features and differences from a tort, a crime, and an administrative offence. Moreover, it may give rise to protection through a special legal procedure involving the imposition of coercive measures, which constitutes legal liability in the broader sense of the term.
