Summary/Abstract: The reorganization of the military courts imposed a new approach in establishing the jurisdiction of the military courts. Although the criminal procedural provisions have drawn the limits of the competence of military courts, the diversity of situations encountered in judicial practice requires a new approach, from a legislative perspective, in the way military courts are organized and function. This article analyzes the competence of the military courts in resolving rehabilitation requests, the way in which the civil and military courts assessed the competence in the resolution of such requests, as well as the way of resolution, not always uniform, of the competence regulator.
