Summary/Abstract: The existence of discrimination in legal relations refers either to the imposition of a different treatment in the case of persons who find themselves in comparable legal situations, or to similar treatment in the case of those in different situations. The regulation of acts of discrimination is based on the non-violation of protected criteria, initially recognized in secondary European law through directives, later being transposed into the national legislation of the EU member states. The article analyzes the national framework regulation on discrimination, starting with the provisions contained in the Labor Code and then with the framework provisions of Government Ordinance no. 137/2000 on the prevention and sanctioning of all forms of discrimination, Law no. 202/2002 on equal opportunities and treatment between women and men and Law no. 76/2002 on the unemployment insurance system and employment stimulation.
