The Concept of the Right to Education in the Legal System of Czechoslovakia between 1948 and 1989: the case of Valéria Matulayová

Summary/Abstract: The right to education is one of the fundamental rights of the next generation and its impact on the progress and prosperity of an individual and the entire society is unquestionable. The guarantee of access to education represents a positive commitment of the state to create such material, legislative and financial conditions that everyone, taking into account the imperative of equal opportunities, can further develop their abilities and knowledge in accordance with current scientific knowledge. The importance of the right to education is emphasized by the fact that this right was also incorporated into the first international human rights document – the Universal Declaration of Human Rights of 1948, but it has also found its application in a number of other international conventions. Finally, the constitutional system of Czechoslovakia also recognizes and acknowledges this right as general, universal and subject to the requirement of equality. However, education can be transformed into an instrument of state power, a space for building and strengthening the ideological foundations of society and the state, enabling the state to exercise control over the future of its citizens and their descendants. The constitutional guarantee of the right to education thus stands in contrast to the reality of one’s access to education. The aim of the study is to conceptually define the right to education in its historical context, identify the international, constitutional and statutory framework of the right to education and, on this theoretical basis, reflect on the investigation and conviction of Valéria Matulayová.
