Summary/Abstract: Law no. 243/2024 regulates the total cost of the loan and the debt recovery activity, with the main objective of protecting consumers from over indebtedness. The new ceilings on Annual Interest Rate and total amount payable significantly limit the costs of consumer credit and clarify the obligations of NFIs and debt collectors. The analysis emphasizes the potentially active role of the bailiff in identifying the exceeding of the legal limits at the time of the application. Existing case law points to challenges in applying the law, including issues of non retroactivity. There is an emerging need for a uniform judicial practice to ensure consumer protection.
