Summary/Abstract: The article examines migration as a social phenomenon and summarizes some aspects of the historical development of migration legislation in Ukraine. Clarifications were made to the key concepts of the study – «migration», «emigration», «refugees». The leading factors of activation of migration processes have been proven. As a result of the conducted analytical work, the peculiarity of internal and international migration was specified, the typology of migration and its variety in terms of time parameters were characterized. Based on generally accepted norms approved by the International Organization for Migration, the importance of irreversible migration for social, economic and demographic development has been proven. The originality of one of the most quantitatively significant and socially complex groups of migrants refugees has been established. Emphasis is placed on the dynamics of the process of Ukraine’s involvement in global migration changes and the development and establishment of the institution of migration law in the country. Increased attention is paid to a special category migrants who have the status of applicants of Ukrainian institutions of higher education; two aspects are singled out the constructiveness of the idea of «dialogue of cultures» and the actualization of their migration capacity and legal capacity. The latter is recognized as the plane of further research of the problem raised in the presented article.
