ORGANIZATIONAL-LEGAL AND PERSONNEL ASPECTS OF THE FUNCTIONING OF THE JUDICIAL SYSTEM IN THE GERMAN OCCUPATION ZONES OF UKRAINE 1941 – 1944: MODERN DOMESTIC HISTORIOGRAPHY

Summary/Abstract: The purpose of the article – to analyze the results of scientific reconstruction of the problem of functioning of the judicial system of the German occupation zones of Ukraine during the Second World War, carried out in the works of modern Ukrainian researchers. Research methods: analytical-synthetic, comparative-historical, hermeneutical. Main results and scientific novelty: for the first time, approaches to the organization and practical activities of judicial system bodies in the occupied Ukrainian territory are analyzed and compared in detail. Practical significance: typical models of creating a simplified system of judicial proceedings in various occupation zones of Ukraine are clarified, as well as the motivation of behavior of persons who were in the service of local courts and the bar; the main trends in the functioning of civil and criminal judicial structures in extreme conditions of war and occupation, their universal and specific features are identified. The originality of the study is based on the clarification and analytical study of the results of modern researchers of historical and legal problems of the Nazi occupation regime, which prove that the local population enjoyed the opportunity to access justice. Article type: research. Main results: the problem of reconstructions of organizational, legal and personnel aspects of the functioning of the judicial system is considered. At the system level, the fundamental approaches of modern researchers to clarifying the problem of organizational and legal registration and personnel support of the work of judicial bodies in the occupation zones of Ukraine are clarified. Interpretative tools, the degree of conceptualization and theorization of little-studied aspects of the functioning of occupation bodies are revealed. An insufficient level of study of the problem of Personnel Support for the work of judicial bodies in the Galicia district, the personal fate of their personnel in the postwar period, procedural, regulatory and some other problems of occupation proceedings was established.
