Drought and water use – comments on the need for changes in the law

Summary/Abstract: The aim of this publication is to review national legislation concerning drought. Since water use is regulated by water law, the article focuses on presenting the provisions of the aforementioned act that concern drought prevention and minimizing its effects. The publication presents the criteria for admissibility and forms of water use restrictions during droughts. Reference is made to the prevention of the effects of drought as an objective of water resource management. It also shows how drought, or the possibility of its occurrence, affects the admissibility of granting a water permit and the possibility of modifying the rights under the permit and revoking them. It refers to sources defining the concept of ‘drought’ and its stages. It indicates the direction in which legislative work in this area should proceed first and what should be the determinant of changes in the law.
