Summary/Abstract: The Balkans is a culturally diversificated region because of what plenty of armed conflicts occurred there. The created here states and their borders often did not respect the ethnic origin of their inhabitants. Since the end of the 20th century, more and more national groups have gained independence and established own states. The aim of the article is to examine whether and how extralegal conditions have influenced the formation of law in selected countries. The research has been limited to the group of behaviors deeply associated with cultural norms, i.e. criminalized acts performed on human corpses and their resting places. The work uses an analysis of the literature on the subject and an analysis of legal acts in nine Balkan countries. The conclusions from the analysis indicate the primacy of cultural conditions in the process of creating legal norms.
