The character of media service contracts

Summary/Abstract: The aim of the study is an in-depth analysis of the nature of media service contracts in the wider context of public contracts. The starting point of the research was the presence of the abstract goal of the service of public interest in different contractual relations. As an introduction, the study examines the appearance of public service and public interest in the literature dealing with the contractual relations of public administration, then the wider administrative law literature of public service and public interest. Next comes the review of the regulation of contracts for linear media services, then the public interest related to the responsible treatment of limited natural resources. In relation to this issue special attention is given to the media policy considerations that need to be a part of management of the state-owned lim-ited resource that is the frequency spectrum. The conclusion of the study is that the media service contract is an example that shows how the special public service relations can be effective tools in the management of limited resources, and this way aiding the public interest that is related to the efficient operation of the state. The research could be able to contribute to the advancement of the Hungarian jurisprudential discourse on the specific contractual legal relations of public administration through the in-depth study of a specific type of contract.
