Summary/Abstract: The Polish legislator, amending the Act of 13 May 2016 on counteracting threats of sexual offenses and protecting minors, included employers and other organizers in the scope of activities related to the spiritual development of minors among the entities obliged to apply the provisions contained therein. These entities were obliged to admit to work and activities with minors persons previously checked in the Register of Perpetrators of Sexual Offenses and after receiving from them certificates from the National Criminal Register in the scope of crimes specified in Chapter XIX and XXV of the Penal Code, in Article 189a and Article 207 of the Penal Code and in the Act of 29 July 2005 on Counteracting Drug Addiction. In addition, religious institutions and entities operating in this area were required to introduce standards for the protection of minors. Thus, entities of the Catholic Church were designated as the addressees of the act. When they began to implement the act, they had at their disposal the provisions of canon law, both universal and particular, regarding the protection of minors and defenseless persons. They also had at their disposal a wide range of preventive programs based on the indications of the Holy See and the Polish Episcopal Conference, which were prepared by institutions established to protect minors. In order to fulfill the obligations imposed by the Polish legislator, a model of standards was developed based on previous regulations that could be used in the practice of various church entities. It contains indications regarding the method of educational work, response to crimes and prohibited behaviors, and recommendations of a preventive nature. These indications often encompass the scope of protection of minors more broadly than required by the Polish legislator. In addition, they also make defenseless adults the subject of protection, seeing them as people particularly vulnerable to crimes and sexual abuse. Such proposals make the entities of the Catholic Church capable of implementing the act on counteracting threats of sexual offenses and protecting minors.
