Summary/Abstract: Given the huge information flowf and easily accessible personal data in today's digital world, the personality of individuals must be adequately protected, including the right to the protection of personal data. However, there are situations when personal data was collected, used, and stored illegally, when there was no legal basis or consent of the individual to dispose of such data. This paper examines the protection of personal data rights in criminal and misdemeanor proceedings. Although violations of these rights may occur outside the national territory, it is important that individuals become aware of their privacy rights and the protection of their data rights even when those rights are violated. In the Republic of Serbia, the case law is still in its infancy and criminal and misdemeanor courts have not rendered many decisions on this matter. The author considers that individuals are insufficiently familiar with their personal data rights, the cases of their abuse, and the possibilities to protect them. As the time comes when individuals will know all the details about the use of their personal data, along with regulations and declared rights, the practice of Serbian courts will be richer.
