Summary/Abstract: The article analyses the specific features of criminal and administrative‑penal liability in Bulgarian healthcare. The medical profession is treated as a legally regulated activity and a source of increased danger, which motivates the use of specific provisions of the Bulgarian Penal Code to protect patients’ life, health and dignity – offences against the person, against life and health, ill‑treatment and breach of professional secrecy. The administrative‑penal provisions of the Bulgarian Health Act are examined as an instrument for protecting public health and patients’ rights to informed consent, emergency medical care, medical confidentiality and professional treatment by adequately qualified staff. The author argues for clarifying certain offences with a possible subject „medical practitioners“ and for achieving a better balance between effective patient protection and legal certainty for the medical practitioners.
