Incorrectness of the first instance decision due to а substantial violation of the rules of procedure

Summary/Abstract: The interest in the study of procedural forms has increased significantly in the recent years. The scientific research is focused on the so-called general legal process. At the same time the sectoral procedural research is developing rapidly – on the legislative process, the administrative process, the tax process, the civil and criminal process, support receives the independence of labour process, land process, etc. In legal literature, the study of procedural forms is usually justified by the need to strengthen the rule of law. This is true because procedural requirements are a guarantee for the proper enforcement of the law and compliance with the rule of law.
