Summary/Abstract: The article analyzes the differences that determine the parties to resort to the arbitral procedure, compared to the common law justice. One of the economic advantages of arbitration is conferred by the lower fees that must be paid compared to the summons to the ordinary courts. Also, the court’s review for the verification of the arbitral award is limited to a court award. Consequently, the authors plead for recourse, where the law allows, to the settlement of disputes between the parties through arbitral proceedings.
