Placement in Police Custody and Escorting a Person to the Premises of the Judicial Body

Summary/Abstract: The purpose of the present article is to analyse, both from a domestic law perspective and from the perspective of the jurisprudence of the European Court of Human Rights, the relation between art. 209 (3) of the Criminal procedure code and art. 31 (1) b) of Law no. 218/2002 concerning the organisation and functioning of the Romanian Police, arguing for the need to include in the term of the preventive measure the period of time that exceeds what is strictly necessary for the purpose of escorting a person to the premises of the judicial body.
