Summary/Abstract: This article is structured into three chronologically ordered parts with reference to the Porumboiu Decision: (i) the pre Porumboiu phase, (ii) the Porumboiu phase, and (iii) the post Porumboiu phase. These three parts are followed by conclusions. One longstanding problem – left unsettled by successive lacunary statutes – was the absence of an adequate and effective instrument available to the beneficiary to neutralize the tax authorities’ enforcement mechanism where legal aid was granted in the form of instalments and/or deferral, in the scenario in which the beneficiary did not (or no longer) wish to continue the proceedings for which legal aid had been granted. Between expressly delimiting in the application the extent of the requested legal aid, prior clarifying judicial dialogue and, waiving the legal aid, the litigant remained trapped: neither avenue guaranteed release from the tax burden. Constitutional Court Decision No. 669 of 3 December 2024 – a ruling with major impact for beneficiaries of instalment plans – addresses this problem in a pragmatic, mutually advantageous, transformative and empathetic manner by introducing the filter of the post hoc dispositive principle into the instalment aid equation. What rights are recognized to the beneficiary? What, concretely, must the Court do, and when? At what point must the Court serve the ruling on instalment and/or deferral to the tax authorities? These are the questions I am trying to answer in the following pages.
