Summary/Abstract: The subject of this paper concerns the reimbursement of meal expenses for employees during work within the general framework of employment relations. The aim of the paper is to examine the right to reimbursement of meal expenses during work in the context of the principles of the prohibition of abuse of rights and the dignity of the employee as an integral part of the right to work. This paper starts from the premise that the prohibition of abuse of rights is a fundamental principle on which the legal system of the Republic of Serbia is based, and with which the regulation and exercise of all rights and obligations must be harmonized — including, in the context of this paper, those related to the regulation and exercise of rights and obligations arising from employment relations, such as the right to reimbursement of meal expenses during work. Furthermore, this right represents an important element of decent work, bearing in mind that decent work is increasingly being recognized as one of the fundamental postulates on which modern labor law is founded. Within such a framework, the freedom to regulate or agree upon the amount of reimbursement for employees’ meal expenses during work cannot be absolute.
