6. Transfer of the concession right in succession law. The legal status of funerary structures upon termination of the concession over the burial plot

Summary/Abstract: This case note examines, within the law of succession, the interpretation of acts of disposition by which burial plots may be the object of an onerous inter vivos transaction and whether such plots (or the associated right of use) may pass by intestate or testamentary succession. The legal characterization of the right pertaining to funerary structures follows from Article 118 of Law No. 36/1995 on Notaries Public and Notarial Activity and Article 18 of the Regulation on the organization and operation of cemeteries, which govern the status of funerary structures where the concession right over the place of interment has terminated.
