The problem of the legal framework of the stealing of weapons, ammunition or the essential components of weapons

Summary/Abstract: Weapons and ammunition embezzlement crimes represent a significant threat to public order and national security, often having serious consequences for society, considering that these facts can lead to the commission of criminal activities not only by situational criminals [8, pag.57], but especially by members of criminal groups or organizations, facilitating the commission of particularly dangerous crimes, such as murder, robbery or even acts of terrorism. In this context, a rigorous and correct legal framing of these criminal acts is essential not only to ensure the efficiency of the process of investigation and prosecution of criminals, but also to prevent recidivism and deter potential criminals. In this sense, the authorities must adopt a comprehensive approach, which includes not only the implementation of strict preventive measures and international cooperation in order to counter the illicit trafficking of arms and ammunition, but also having a well-calibrated judicial system for such crimes by adapting the normative framework without divergences and legislative interpretations that will finally allow the application of sanctions proportional to the gravity of the facts, having the role not only to punish, but also to protect society from future risks.
