Summary/Abstract: The influence and disruption of democratic processes in the Republic of Moldova by imperialist and expansionist clichés, secessionism and separatism, hybrid informational warfare, and external interference in electoral processes are largely conditioned by the vulnerabilities posed by national security. The primary objective of this study is a critical examination of the crime of treason as viewed through the criminal legislation of the Republic of Moldova, where the incrimination is based on the idea of protecting state security through legal and penal means. As a result of the research, several vulnerabilities have been identified and explained, mainly determined by the lack of alignment between the preventive effect of criminal law and new behaviours and actions aimed at the internal and external security of the Republic of Moldova. In this context, the author has justified the need for legislative amendments to optimize, modernize, and improve the preventive effectiveness of criminal law in addressing criminal behaviours that endanger or harm national security.
