Summary/Abstract: The International Court of Justice’s Advisory Opinion of 23 July 2025 on climate change obligations inaugurates a significant turn of events, being situated within a broader triad of recent international decisions that reposition climate change as a question of binding law rather than mere policy. Against the background of a decade since the Paris Agreement and in the run-up to COP-30, the ICJ consolidates a unified normative baseline: treaty-based duties under the UNFCCC/Paris regime are complemented—never displaced—by customary international law and general principles (sustainable development, equity, intergenerational equity, precaution), thereby foreclosing lex specialis claims that would exclude wider international rules. The Opinion is also affirming climate-related erga omnes obligations, grounding a robust standard of due diligence and cooperation, and clarifying that international wrongful acts arise not from emissions per se but from actions or omissions causing significant harm to the climate system in breach of legal duties. The consequences identified — cessation, assurances of non-repetition, and full reparation — re-energize state responsibility in the climate context and open doctrinal avenues for national and transnational litigation.
