Summary/Abstract: The rapid evolution of artificial intelligence poses many legal challenges, requiring legislation to be adapted to properly regulate the use of this technology. In the field of intellectual property, there are difficulties in establishing rights to AI-generated creations, such as ChatGPT. Questions on the legal liability of AIs in situations of injury are key to the development of an effective legislative framework. While most countries do not prioritise AI regulation, the European Union has introduced new rules to protect people affected by AI system errors. In this context, there is a need for clear and tailored legislation that strikes a balance between innovation and the protection of fundamental rights, ensuring legal accountability in the use of AI. This study aims to answer and propose solutions regarding the legal liability of AI systems.
