Summary/Abstract: Green Public Procurement (abbreviation GPP) is used as an instrument that can be used by public authorities of countries when purchasing goods, services and works that have a reduced environmental impact throughout their life cycle. Accordingly, the EU is developing the GPP criteria as a more adapted response to scientifically proven environmental impacts of certain groups of goods, services, and works. Therefore, these criteria must be subject to constant testing and revision and keep pace with social and technological progress. The ultimate goal is to significantly reduce negative environmental impacts through their application in public tenders in the EU. It is important to note that GPP is still a voluntary instrument at the EU level while the decision to prescribe the obligation to implement it is left to national legislations. This raises the key question and the objective of the study in this scientific paper: should the EU take a more serious approach and therefore legally prescribe the obligation to use green criteria in public tenders or maintain the current voluntary approach?
