Summary/Abstract: The use of technology and artificial intelligence raises major legal issues. Among these, we mention decision-making responsibility (to what extent a decision based on an algorithm can be challenged in court and who is responsible for any errors - the environmental authority or the technology provider), algorithmic transparency (European legislation requires the explainability of automated decisions, which in the environmental field means that operators and citizens must understand how a conclusion regarding a possible sanction was reached) and data protection (monitoring sometimes involves the indirect collection of information on economic activities or even individuals, and it is necessary to ensure compatibility with the General Data Protection Regulation). Consequently, technology and artificial intelligence not only facilitate environmental monitoring, but also require an adaptation of the legal framework to maintain the balance between efficiency and respect for fundamental rights.
