Summary/Abstract: The adoption of the new Criminal Procedure Code led to the explicit regulation of certain institutions and procedures designed to better reflect the general principles of law and to provide the suspect or defendant with greater guarantees for the protection of their rights. One of these changes is the express provision of the adversarial-origin principle of the separation of judicial functions in Article 3 of the Criminal Procedure Code.
