Summary/Abstract: In this paper, we will attempt to determine whether the prosecutor’s orders (specifically those of non-prosecution/non-indictment) do or do not carry the authority of res judicata, and if the answer is affirmative, what the scope of this authority is and to whom it may be opposed. We will begin our approach with a general overview of the concept of res judicata and its effects, followed by an application of the outlined principles to the specific case of the prosecutor’s orders terminating criminal proceedings.
