The Application of the General Individualization Criteria. Valences and Controversies

Summary/Abstract: The general individualization criteria contribute to the realization of one of the most important and most sensitive operations according to the purpose of the criminal law sanctions. The problem which arises concerns the way in which the courts understand to use this data about the deed and the perpetrator, so that an efficient anti-criminal reaction is reached. The application of the general individualization criteria represents a seemingly easy operation, but which, thoroughly analysed, gives rise to a series of controversies sometimes fuelled by the lack of consensus in the legal literature and the judicial practice.
