Repair of the Damage Caused by the Abusive Breakup of the Engagement

Summary/Abstract: Engagement is a pre-marriage stage which entails rights and obligations on the fiancés, being an institution of civil law producing genuine legal effects. However, the case-law is relatively poor in cases which have as their object compensation for the damage caused by the abusive breakup of the engagement. This is because it is not known that such damage can be legally repaired and people consider the engagement to be part of the mere sphere of privacy. One thing is clear, whether it is material or moral damage, if the engagement has beenwrongfully broken, the culpable fiancé may be obliged to compensate the damage caused to the 'innocent' fiancé. This article aims to analyse from a practical perspective the most important effect that the engagement creates, that of repairing the damage caused by the abusive breakup of the engagement.
