Identification of provisions of international law that may be violated as a result of certain behaviour of public officials towards women in detention on remand

Summary/Abstract: The author considers that in the situations described in an order to prepare the legal opinion thereis a possibility of qualifying the actions as examples of violation of the prohibition of degradingtreatment or the right to respect for private life. The indicated state of facts provides a basis forconcluding that there is a high probability of a violation of human rights protected by the treatiesby which Poland is bound, in conjunction with the recommended international standards con‑cerning detainees. An additional aggravating circumstance is that the victims of the violation arewomen, who belong to the category of ‘vulnerable’ victims, subject to more extensive internationalprotection.
