Summary/Abstract: This opinion is an analysis of the Deputies’ Bill Amending the Act on Patient’s Rights and the Pa‑tients’ Rights Ombudsman and Certain Other Acts. The author indicates that the Bill, which pro‑vides for the possibility for a minor to receive certain health services without the consent of a legalrepresentative, may result in a disproportionate interference in the sphere of constitutionally pro‑tected parental authority and the rights of the guardian. In addition, the proposal may violate theconstitutional principle of equality in regard to access to services by unjustifiably favouring minorsover the age of 16. The author also notes the lack of consistency of some provisions with the exist‑ing normative solutions and raises doubts about the possibility of achieving the ratio legis of the Billthrough the introduction of the proposed catalogue of health services.
