Abuse of Authority as a Special Variant of Abuse of Office

Summary/Abstract: The purpose of this article is to present the legal construction of the crime of abuse of authority and to expose it to a comparative analysis with the legal structure of abuse of office, revealing at the same time the relationship from special to general between them, for the correct application of the corresponding criminal law norms and the remediation of some aspects related to them. This study includes, in the first phase, a brief presentation of the public order and national security system and of the military activity within it, with the purpose of putting into context the information and problems that will be shown later. Also, the article presents general observations about the two indictment rules and highlights the differences between them, in terms of subjects, objective side and sanctioning treatment. At the same time, deficiencies in relation to the configuration of the abuse of authority and problems arising from the differences in the sanctioning treatment established by the indictment rules in question are presented.
