Determining or Facilitating Sexual Acts Between Minors

Summary/Abstract: The reconfiguration of crimes that sanction the violations of the sexual freedom and integrity of minors brought to the positive law plan a new vision of the legislator regarding the interventions of majors in the sexual life of minors at the threshold of development, given the protection that the latter should enjoy in the process of growth and physical and mental maturation. The text introduced by art. 2192 C.pen., by Law no. 217/2023, having as marginal name the determination or facilitation of the maintenance of sexual acts or sexual acts between minors, has special peculiarities, given the effects that this legislative policy approach will have in terms of substantive law in relation to the criminal liability of persons involved in sexual acts maintained by minors. This study aims to make an incursion into the content of the new regulation, starting from the purpose of the law and reaching practical issues that raise questions or criticism.
