Summary/Abstract: The European Account Preservation Order is a procedure which allows a court in one EU Member State to freeze funds held by the debtor in one or more bank accounts in one or more other EU Member State(s), where there is a real risk that by the time the creditor reaches the point of enforcement, the debtor will have dissipated or hidden his assets, in order to ensure the subsequent recovery of cross border claims. With this article, we aim to analyze the scope and material conditions for issuing the European Account Preservation Order, highlighting the provisions that have generated divergent interpretations as well as the trends for their clarification.
