Summary/Abstract: This study aims to clarify the general jurisdiction of Romanian national courts regarding the establishment of the residence of minors by presidential ordinance, a procedure provided by art. 997-1002 of the Code of Civil Procedure, in the case of international child abduction as a method of consolidating the new habitual residence of the minor obtained through the illicit movement of the minor on the territory of the Romanian state. For this purpose, we will proceed to analyze the case law of the Romanian courts in accordance with Regulation (EU) No. 1111/2019 on jurisdiction, the recognition and enforcement of decisions in matrimonial matters and the matters of parental responsibility, and on international child abduction, and the case law of the Court of Justice of the European Union.
