Some Considerations Regarding the Sanctioning of the Plurality of Crimes in the Case of Escape

Summary/Abstract: This article aims to critically analyze the sanctioning rules of the plurality of crimes in the case of committing the crime of escape from imprisonment, whether or not followed by the commission of other crimes after the escape. The topic is particularly interesting as a result of the amendment of Article 286 of the Penal Code by Law no. 146/2021, which generates not only different solutions depending on the circumstances in which the escape occurred, but also consequences that are difficult to reconcile, generated, apparently, by the lack of coherence from the legislator when he operated this amendment.
