Summary/Abstract: The legal basis of the request for separate court costs remains art. 453 of the Civil Procedure Code, a provision that transposes a special form of tortious civil liability in the field of civil proceedings. We consider that the assessment of procedural fault cannot be made separately from the condition of winning/losing the trial; however, judicial practice is not uniform regarding this aspect.
