AXIOLOGICAL FUNDAMENTALS OF MATERNITY RISK PROTECTION UNDER SOCIAL SECURITY LAW

Summary/Abstract: The elaboration is dedicated to theoretical assumptions of maternity risk protection, present-ed against the background of changes in the society, transformation of labour market, as well assuccessive amendments to labour law and social security law. International, European and constitu-tional foundations of maternity protection have been presented. Author introduces legal nature anddevelopment of maternity allowance. De lege lata this benefit constitutes a component of socialinsurance and it belongs to sickness scheme. Moreover, Author pays attention to parental benefit thathas similar purpose but is financed directly from the state budget. In Author’s view, from theoreticalperspective it would be appropriate to introduce the social risk of parenthood instead of the socialrisk of maternity. De lege ferenda maternity allowance could be replaced by parenthood allowance,as an element of family protection scheme.
