18. The inalienability of lands belonging to some associative forms

Summary/Abstract: In order to preserve, but also protect the property right belonging to various associative forms, the legislator regulated the provisions of art. 95 of the Forestry Code. The inalienability established by these legal provisions does not apply to the dismemberment of the right of ownership. On the one hand, such a limitation is not provided by law. On the other hand, the disassembly of the property within the meaning of the provisions of art. 693 Civil Code et seq. it does not involve the alienation of an asset, but on the contrary, it considers the enhancement and exploitation according to its destination.
