Summary/Abstract: Even if the debtor company was ordered to have its trade name cancelled and struck off the commercial register, it must be acknowledged that the debtor company continued to exist as a legal subject, identified by its other attributes – registered office, tax code, number in the commercial register, and may, if the legal conditions are met, be subject to insolvency proceedings.
