11. Debt assignment. Implications about forced execution. Lack of creditor capacity to the transferred debtor

Summary/Abstract: This paper refers to the issue of the debt assignment incurred before the start of the forced execution procedure. More specifically, by analyzing the court decision, we intend to establish the directions of interpretation of the situation in which the conditions for the opposability of the debt assignment to the transferred debtor are not accomplished and the consequences on the enforcement procedure.
