Summary/Abstract: This article examines the significance of conscientious objection in the contextof the political philosophy of Ernst-Wolfgang Böckenförde, a German jurist and philosopher.To this end, we outline his views on topics such as the emergence of the modern state aspart of the process of secularisation, the dialectic of power and freedom, and the necessityof a relative homogeneity in a pluralistic society. Böckenförde’s work articulates the conceptof conscientious objection as an essential element of a democratic state under the ruleof law, relating it to constitutional freedom of conscience.
