Summary/Abstract: The prosecutor is often seen as that magistrate who exclusively exercises the function of prosecution in criminal matters. But from the set of legal provisions in the field, we notice that the prosecutor also plays an important role in the protection of incapacitated persons, whether we are talking about minors or people with intellectual and psychosocial disabilities. The new regulations in the field, brought by Law no. 140/2022 reiterated this role of the prosecutor, in protecting these categories of persons, especially with the aim of respecting the rights and freedoms of persons, ensuring their equality before the law, and ensuring a non discriminatory legal treatment to all participants in the judicial proceedings, regardless of their quality. The present paper analyses the current legal framework, the areas in which the minor or person with intellectual and psychosocial disabilities is protected through the intervention of the prosecutor and his powers to protect persons without legal capacity or with limited legal capacity.
