Summary/Abstract: The challenges related to the aging of the population not only tip the protective balance towards the rights of older adults, but also towards those in charge of their care, assistance and protection. The rights to care and to care demand protection from a human and constitutional rights approach, where the concepts of well being, quality of life, and dignity are realized from a legal civil perspective. The proposals of the Cuban Family Code for the protection of the rights of family caregivers and their obligations have no precedent in the Latin American area. So, protection ranges from the regulation of a set of rights to particular mechanisms such as the maintenance contract, inheritance protection for caregivers and principles of family cooperation.
