Summary/Abstract: The purpose of this research is that of demonstrating that the measures taken with regards to education in the last nine month of the year 2020 in the context of the Covid-19pandemic, have been disproportionate in relation to fundamental human rights. The two essential traits of education, availability and accessibility, have suffered mutations, the programs being applied in a chaotic and fragmentary manner in an educational approach that was centered and is substantiated on the computer abilities of the pupils and students, in the detriment of their aptitudes. The legal aspects emphasized in the present article have the role of underlining the manner in which education was belittled, and what are the consequences of having moved teaching, learning, and assessment in the on-line environment.
