Summary/Abstract: The death of a person generates, in addition to feelings of sadness and despair at the level of the family and close people, legal implications through the need to transmit the inheritance of the deceased to his successors, which inevitably implies the meeting with legal professionals, or with the notary public when there is an agreement between the heirs, and the succession will be debated in a gracious procedure, non-contentious, either with the judge and lawyers when there are conflicts, and the procedure is a contentious one.In this study, we have proposed to analyze the impact of the new changes at the level of competence in order to debate the succession procedure by notarial means starting from the general case, but without omitting particular aspects that may become applicable in given hypotheses.Therefore, considerations regarding jurisdiction will be considered, on the one hand in relation to the non-contentious sphere, with everything that arises from the instrumentation of a notarial procedure, and on the other hand, in a comparative note, the regulations related to the inheritance procedure carried out before the court will be analyzed.
