Summary/Abstract: The Romanian Government has submitted to public debate the Draft to amend and complete Law no. 85/2014 regarding insolvency prevention procedure and insolvency procedure on the transposition of Directive (EU) 2019/1023. The Directive aims to harmonize internal legislations on preventive restructuring and insolvency. The Draft under public debate replaces the ad hoc mandate procedure with a new procedure that is unknown to the Romanian law, i.e. the restructuring agreement.
