ETHIC STRUCTURE OF KANUN: DOES IT COMPRISES INITIALL FORM OF ETHICS IN HUMAN SOCIETY?

Summary/Abstract: Geg tribes, in mountains of Northern Alabania, have had a moral code, called Kanun. In an organized society based on kinship, as functioned the society in these remote mountains till recently, in a society, where juridical system was not functioning as it should, an act of vengeance, made by hurt party, consists the last penalizing measure towards defector or violent party, but, at the same time, it is the neccesary act to re–establish and secure social peace in human society. In these region of Northern Albania, is considered fair any act of vengeance towards an offender or violater that does any ugly act, classified as amoral by Kanun. The issue of origination and development of moral and social order in a society without national authority, presents a complicated problem, which people acquired to solve long ago. It is reasonable to think that, before appearance of national authority in a society, people have lived in a society without such authority. First, Thomas Hobs found origin of social order, in a society without national authority, in so called social contract, Sustaining on his theory of social contract, further, Russo, but also Nietzsche and Gerard put forward other theories regarding the origin of social order. However, all these theories seems to have failed in motivation of the fact that, a society without authority, has its moral principles, that are established and elaborated spontaneously, as a result of heathenish culture. Kinship society, in those regions of Northern Albania, where instead of national power was dominating normative power of Kanun, has its moral principles and its original social order, elaborated within.
