Summary/Abstract: Access to pre-contractual information is a basic consumer right. As a condition for transparency, this information, which is required by law, must also be made available to consumers in a clear and comprehensible way in the online marketplace. Pre-contractual information requirements for contracts concluded on the online market are set out in a number of complementary legal sources. These legal sources impose obligations on both the business and the online marketplace as an intermediary service provider. On the one hand, these legal sources define the content of the prior information and, on the other hand, lay down the requirements for both market players to provide clear and comprehensible information and to be transparent. The study examines the question of the identification of the traders, the provision of contact details and the determination of the legal status, in addition to the definition of the parties responsible for each of the elements of the information protocol. A particular focus will be on the due diligence obligations imposed on the online market, in particular on the traceability of traders, and on the compliance by design.
