Summary/Abstract: The outbreak of armed conflict in Ukraine on 24 February 2022 led to the displacement of an impressive number of people from the territory of the neighboring state throughout the European continent and, especially on the territory of the neighboring states of Ukraine, including Romania. The conflict led to a violation of fundamental human rights and freedoms, a reduction in the security of Ukrainian citizens and those legally residing in Ukrainian territory at the outbreak of the conflict, especially in areas direct armed confrontations. All this has led to a massive influx of displaced persons who have put pressure on asylum at EU Member State level, in particular on neighboring Ukraine Member States. Therefore, there was a need for solidarity and a rapid response, common and effective on the part of the European Union to manage this massive influx of people and in particular to ensure the protection of these people, their rights and freedoms. Such a response was the activation of the Temporary Protection Directive by the Implementing Decision (EU) 2022/Council Regulation (EC) No 382 of 4 March 2022 establishing the existence of a massive influx of displaced persons from Ukraine within the meaning of Article 5 of Directive 2001/55/EC and having the effect of introducing temporary protection. The activation of the Temporary Protection Directive and the implementation of the provisions of the Council Decision of March 2022 are clear evidence of the solidarity of the authorities of the Member States of the European Union in ensuring respect for the rights and freedoms fundamental human beings but also in the management of the field of asylum in an exceptional context.
